There is no 'question' here. If the victim was walking away from the shooter
when he was shot, there is no right to use deadly force. Like the case of Byron
Smith a few years ago (http://tinyurl.com/y4hzg79a), there is no right to shoot
people who are not threatening you. (Of course you are free to mount a defense
saying you feared for your life.)

Posting a sign in your window saying you'll shoot trespassers is unlikely to
play well with a jury, if this goes to one.
