(ZBA)
The Zoning Board of Appeals is a quasi-judicial board whose role is to
interpret the Framingham Zoning Bylaw in appeals of denied building permits or
other determinations of the Building Commissioner; and to hear petitions for
Special Permits and Variances subject to the requirements of Mass. General Laws
Chapter 40A. The Board is also designated to decide appeals and petitions for
variances for signs that do not comply with the Sign Bylaw.
Roles and Responsibilities:
The Framingham ZBA is a responsible for, but not limited to the following
activities:
Interpretation of the Framingham Zoning By-Law for appeals relative to denied
building permits or other determinations of the Building Commissioner.
Review of applications for development and land use projects. Such project
applications include Special Permits and Variances.
Review of sign appeals and variance petitions pursuant to the Framingham
General By-Laws Article VII.
Review of affordable housing projects proposed under M.G.L. Chapter 40B.
Membership Terms and Expectations:
Membership includes three (3) regular members and (4) associate members.
Regular voting members vote upon each case, unless such authority is delegated
to an associate member by the Chair of the ZBA.
Associate members of the ZBA serve as voting members when the Chair of the ZBA
designates them to sit on a case. Three associate members always serve as
voting members on sign cases.
Attendance by regular and associate members is expected at all meetings of the
ZBA.
ZBA meetings are hosted on the second Wednesday of each month at 7:00pm. The
chairperson may decide to call additional special meetings or change the
frequency of the Board’s meetings.
Member Skill Set:
Those seeking membership on the ZBA should ideally possess a diverse background
that demonstrates experience in land use compliance and regulation, urban
policy, and an understanding of zoning. At a minimum, candidates should have an
understanding and/or working knowledge of the following:
Zoning by-laws/ordinances, land use policies, and the application thereof;
Massachusetts General Law (M.G.L.) Chapter 40A;
Interpretation of property rights and policy; and
Site plan and development plan review.

[Under Article II, Section 10 of the Charter, the mayor shall submit to the
council the name of each person the mayor desires to appoint to any office as a
division head, the citizen participation officer, or as a member of a
multiple-member body. The council shall refer each name that is submitted to it
to a standing committee of the council which may investigate each candidate for
appointment and may make a report, with recommendations, to the full council
not less than seven (7) nor more than twenty-one (21) days after the referral.
