Good afternoon,
Further to the acknowledgement below, I can respond as follows:
An enforcement notice was issued on 14/9/09. A subsequent appeal against the
notice was dismissed. A later site visit confirmed that the notice had, to all
intents and purposes, been complied with as the property was then in use as a
delicatessen/sandwich shop, with a few tables and chairs available (such use
falling within use class A1). No follow up action was considered appropriate
because of a decision made by the (former) North East Area Committee to grant
planning permission (against the Local plan policies) for a similar use nearby.
I understand that since the service of the enforcement notice (and its
compliance), the property has changed hands. As a result, and as it is possible
that the present occupier is unaware of the enforcement notice or its
requirements, Mark Spragg (the enforcement officer covering the Headington
area)
has visited the premises. In a letter dated 30/6/11, he advised the occupier of
the action needed to comply (again) with the notice, although the occupier has
stated that such changes would be difficult to achieve and make the business
unviable. In the circumstances, because of the recent decision by the former
Area Committee to grant planning permission for a similar change of use nearby,
Mr Spragg has suggested that a further application should be submitted.
