We have a duplex on our block that has been sitting vacant for over two years.
Over a year ago the City slated it for demolition. It has not been demolished
yet. Apparently it is scheduled for a hearing (the mortgage company that now
owns it is appealing the demo recommendation) in front on the Nuisance
Condition Process Review Panel on November 8, 2007. None of the neighbors
within 350 feet of the property (that i have spoken with) received
notification, and neither did PPNA. I only found out about this because I have
been in contact with regulatory services forever about this, and at our block
club meeting last week Elizabeth Glidden provided an update that included the
11/8/07 hearing date.
Nonetheless, we have received no official notice and we would like more time to
prepare our testimony etc. Do we have any recourse?
This whole thing is being allowed to go to appeal because the mortgage company
threatened to sue because they said they didn't get their due process (this is
an over-simplification, but the whole story is too long to relate in full).
So, when citizens are not given their due process, what is our recourse? Can
we request a hearing delay? Do we have to threated a lawsuit?
