Article 14 is a RATHER important article that is coming before town meeting in
the fall concerning "PEG Access and Cable Related Fund.
Town Warrant article 14: Access and Cable Related
To see if the Town will vote to accept the provisions of Massachusetts General
Law Chapter 44, Section 53F 3/4 in order to establish a separate revenue
account to be known as the "PEG Access and Cable Related Fund", into which will
be deposited funds received in connection with a franchise agreement between
the Town's cable Operator and the Town and from which monies shall only be
appropriated for cable - related purposes consistent with the franchise
agreement, including, but not limited to:
(i) support of public, educational or governmental access cable television
services;
(ii) monitoring compliance of the cable operator with the franchise agreement;
or
(iii) preparing for renewal of the franchise license.
The franchise agreement states that the operator, COMCAST cannot CENSOR anyone
for any reason. Jim Rizoli had brought that issue up at the Selectmen meeting
where he discussed the Comcast Cable agreement to deaf ears

The cable operator COMCAST is allowing AF-TV to CENSOR the Rizolis.
Pages 4,5,6 of the AF-TV "policy and Procedures" states that shows that contain
obscene material are to be put into SAFE HARBOR.
If a user/producer violates copyrights, do not broadcast the show or
place it in SAFE HARBOR. Discuss it with the user/producer. Each and every
time.
If a user producer violates rules on content, place it in SAFE HARBOR.
Discuss it with the user/producer each and every time.
There is no rational reason other than political/religious hatred, to
actually ban anyone from AF-TV unless they were dangerous to the staff of
AF-TV.
I was at the meeting that got them banned off the air.
SAFE HARBOR exists to sidetrack the shows that violate AF-TV rules because
someone who signed their cable statement for obeying rules on the shows that
they were going to produce, made a mistake in their production and instead of
being banned, the Safe Harbor was made for that purpose.

Their is no other explanation for the page 5 agreement even being written
unless a program could cause a problem that has material that is inapropiate
according to AF-TV rules.
AF-TV obviously broke it's own rules when they censored the Rizolis when they
simply should have moved them to Safe Harbor.
AF-TV will not reveal who gets banned, who gets kicked out, etc.
Therefore COMCAST is not in COMPLIANCE with their franchise agreement because
they allowed AF-TV to CENSOR CONTENT by banning the Rizolis. The show should
have been put in SAFE HARBOR according to page 5 Policy and Procedure
agreement.
One more point of contention.
In discussions about this situation with the Rizolis they said they were
accused of putting "nudity" on the air in violation of the statement that they
signed when they came to sign up for production. WHAT was the nudity? The
Rizolis claim it was a forensic picture of a dead woman from behind showing
what happens when a person dies by asphyxiation. They were trying to make a
scientific point not a sexual point. AF-TV may not understand the difference.

I think this makes a big difference then what AF-TV claims as nudity.
To use this accusation was nonsense, and was just an excuse for AF-TV abusing
their power. If this was true then the AF-TV people were OBLIGATED and
MANDATED, to put the show containing this material in SAFE HARBOR even without
the approval from the producer's, the Rizolis. This is what is explained in
pages 5,6 of the policies and and Procedures.

Bottom line is that if AF-TV has a problem with any show or producer, they
can meet with the producer, talk about their concerns, communicate their
concerns, perhaps move a show to SAFE HARBOR but never ever censor a show by
kicking someone out. Violations of rules should be easy to work out with
the producers.
If AF-TV were honest, they would show us the complaints about other shows
(if any) and who else was banned from AF-TV (nobody but the Rizolis).
Regretably, they are not honest, forthcoming or even fair.
